What Should a Rental Agreement Include?

A useful rental agreement identifies the parties and property and makes the practical terms clear. The exact legal form depends on where the property is and the tenancy type, so a generic document should never override mandatory housing law.

Parties and property

Identify the landlord, tenant or joint tenants, the rental property and the date occupation starts.

Rent and payment

State the rent, when it is due, how it is paid and the rental period. In England, most assured private tenancies are periodic under the post-1 May 2026 system.

Deposit and responsibilities

Record any deposit and clearly describe agreed responsibilities such as utilities, permitted use, care of the property and other lawful conditions. Separate statutory requirements may also apply to deposits and property safety.

Ending the arrangement

A template should not promise that a tenancy ends automatically on a date where the law says otherwise. In England, assured tenancies are rolling; Scotland uses open-ended private residential tenancies; Wales has its own occupation-contract system.
