Can I leave without working my notice?
Employees who resign usually have to work their notice period. ACAS says the amount of notice should be set out in the written statement or employment contract, with statutory minimum notice applying in some circumstances.
Start with your notice obligation
Check the employment contract and written statement. If you have worked for at least one month, the statutory minimum is generally one week unless a contractual or other exception applies.
You can ask to leave earlier
An employer and employee can agree an earlier leaving date or another arrangement. Get any agreement in writing so there is a clear record.
Leaving without agreement
Walking out before the required notice ends can have contractual consequences. If there is a serious contractual breach or another exceptional situation, the position can be different, so individual advice may be appropriate.
Keep the resignation itself clear
Even if you are asking not to work all of the notice, state that you are resigning, the notice you understand applies and the leaving date you are requesting.
